DIRECT MAIL CONNECTION RENTAL DATA USE AGREEMENT

This agreement is made between Direct Mail Connection and the Customer. This agreement is personal to the Customer, and may not be transferred voluntarily or involuntarily to a third party.

Background
Direct Mail Connection procures data from various national databases, which is derived from various sources. The customer wishes to obtain list counts and order marketing lists selected from various sources that Direct Mail Connection utilizes. These terms and conditions are incorporated into and constitute the Agreement between Direct Mail Connection and the Customer, concerning compilations of information and data provided on a per order basis. This Agreement shall be constructed, interpreted and enforced under the laws of the State of Georgia.

Restrictions and Conditions on Use of the Data
Data furnished by Direct Mail Connection to the Customer may be used by the Customer, or their own Customers as end users in connection with their own marketing programs, and for no other purpose. The Customer agrees to furnish such data on a rental basis only.

The Customer will not use or permit use of the data in violation of any federal, state or local law rule, or regulation or for any unlawful purpose, and should comply with the Direct Marketing Association's Ethical Use and Fair Information Practices Guidelines.

Limitations of Liability; Indemnity
Direct Mail Connection agrees to provide information from recognized industry compilers of telephone directories and other sources. Direct Mail Connection has no control over the accuracy of such information and does not guarantee its accurateness or completeness or deliverability. In no event shall Direct Mail Connection be liable for loss of profits or direct or indirect, incidental or consequential damages for any nature whatsoever, any undeliverable mail pieces*, disconnected phone numbers**, or for any other claims regardless of the form of action.

* 7-10% is an acceptable undeliverable rate
** 15% is an acceptable disconnect rate
Customer Responsibilities
Upon receipt, the Customer shall inspect the data for compliance with the Customer's selection criteria. If verifiable errors are reported to Direct Mail Connection within 14 days, Direct Mail Connection shall reprocess the order without charge. No returns are allowed after 14 days.
